4. No Guarantee of Results
3BD Systems does not guarantee any specific results, outcomes, revenue increases, lead generation numbers, or business growth from the use of our services. Individual results will vary based on a wide range of factors including, but not limited to, market conditions, business type, client effort, and implementation. You acknowledge that your results may differ materially from any examples provided.
5. Payment Terms
Payment terms, amounts, and schedules will be specified in the applicable proposal or service agreement. Unless otherwise agreed in writing:
- No payment is required until you have reviewed and approved the delivered work.
- Final deliverables are released upon receipt of agreed payment.
- Deposits, if applicable, are non-refundable once work has commenced unless otherwise agreed.
- Late payments may be subject to a late fee of 1.5% per month or the maximum rate permitted by law.
- 3BD Systems reserves the right to suspend services for overdue accounts.
6. Intellectual Property
Company IP: All content on this Site — including text, graphics, logos, images, and code — is the property of 3BD Systems and protected by applicable intellectual property laws. 13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Texas.
Before initiating any formal legal proceeding, both parties agree to attempt to resolve any dispute through good-faith negotiation for a period of at least thirty (30) days.
14. Entire Agreement & Severability
These Terms, together with our Privacy Policy and any executed service agreements, constitute the entire agreement between you and 3BD Systems regarding your use of the Site and our services, and supersede all prior understandings.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
